Md. Nasir Uddin (Special Correspondent): Barrister Asaduzzaman Fuad, joint member secretary of Amar Bangladesh Party-AB Party, said that high court benches should be formed in every division and important district towns through decentralization by establishing an independent judiciary.
(Tuesday, October 1) He spoke at a press conference organized on the occasion of the political party's 15-point proposal for reforming the judiciary at the central office of the AB Party in the capital.
Barrister Asaduzzaman Fuad, citing 15 points of recommendation, said that the Administrative Secretariat for Law and Justice should be formed immediately under the Supreme Court. Whose appointment, transfer, promotion will be free from the control of the executive department.
The Attorney General's Office, the Office of Public Prosecution, including the appointment of High Court Judges, should be transparently accountable and institutionalized.
The police can play no role in the prosecution of criminal offenses other than investigation. Timely submission of investigation report should be arranged to avoid procrastination, so independent prosecution team should be formed under the same secretariat.
Judicial Qualifications Talent, experience, conscientiousness, honesty and devotion should be the only qualifications to be judges and justices. No appointment can be made on political grounds.
Barrister Fouad said that one cannot become a lower court judge without a minimum of five years of experience in the legal profession. The number of judges in proportion to the population and the benefits of judicial candidates should be increased to reduce the backlog of cases.
He also said that those who want to engage in the legal profession should undergo a one-year training under the Bar Council. No meritorious student shall be denied a course on account of financial inconsistency. There will be no further examination to be registered as a lawyer in view of the assessment here.
Barrister Fuad said, party politics should be stopped in the court premises. The culture of tarnishing the image of the court by posting slogan banners in procession meetings should come out. In that case provision should be made to separate each bar from the judicial court boundaries.
43 lakh cases are pending and these cases should be disposed of quickly. Barrister Asaduzzaman Fuad also laid importance on rebuilding Bangladesh through the establishment of rule of law and justice.
